Edward Hopkins & Latoya Cole v. Art Express, Inc. & Gilbert Central Corporation, United States District Court, Eastern District of Arkansas, $3.75 Million Settlement
Four members of an extended family were killed by smoke and fire when they were trapped inside their vehicle that was crushed after being hit from behind by a tractor-trailer rig and pushed into the back of another truck. The wreck happened in a construction zone on Interstate 40 just outside of West Memphis, Arkansas. Bruce McMath and Charles Harrison of McMath Woods P.A. were lead attorneys for the estates of three of the four decedents and were successful in developing theories of liability against Gilbert Central Corporation, the general contractor on the highway project, which led directly to a favorable settlement.
The owner of the tractor-trailer rig, Art Express, Inc., paid all of its $750,000 in liability insurance coverage, while Gilbert Central paid an additional $3 million to the four estates to settle the case just a week before the start of trial.
Alvester Moore et al., v. Great American Assurance Company and Mike Dupuis, Circuit Court of Union County, Arkansas
Plaintiffs alleged wrongful death after their daughter drowned at a pool party.
The deceased was attending a birthday party at a swimming facility. Forty minutes after arriving she was found, by other children, sitting at the bottom of the pool.
Plaintiffs alleged that the defendants were negligent in the operations of the facility, failing to provide and supervise adequate lifeguards, and necessary safety precautions associated with managing the swimming pool.
The case settled. The plaintiffs were represented by Bruce McMath, Sam Ledbetter, Will Bond, and Allen Roberts.
